Privacy should be easy to understand.

This policy applies to the Eclipse Education iOS and Android app used by students for practical assessment activities. It explains what information the app handles, why we need it and what choices you have.

1. What this policy covers

Eclipse Vale Pty Ltd trading as Eclipse Education is an Australian Registered Training Organisation, RTO #32252. We manage personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), as applicable.

The app is used to connect a student to a practical assessment activity and to record or submit evidence requested by Eclipse Education. This policy covers information handled through that app. Our Policies & Procedures and Terms & Conditions explain our broader approach to students, enrolment, training, records and the website.

Important Deleting the app from your phone does not delete assessment evidence that has already been submitted to Eclipse Education.

2. What information we collect

We collect the information needed to identify the assessment activity, receive your evidence and administer your training. Depending on how you use the app, this may include:

Student and assessment details Your student ID, assessment number, course or unit reference, and a QR code or manual code used to connect your submission.
Video and audio evidence Recordings you choose to make for an assessment, including your image, voice, movements and anything visible or audible in the background.
Submission details Information associated with receiving and reviewing a submission, such as the assessment reference, file type and submission timing.
Support information Information you provide when you contact us about the app, an upload or an assessment issue.

A recording is personal information if it identifies you or could reasonably identify you. It may also incidentally contain information about other people, your home or workplace, or other personal details. Please record only what the assessment requires and avoid recording anyone who is not involved.

The app is not intended to collect unrelated sensitive information. Do not include health, identity-document, financial, family or other sensitive information in a recording unless the assessment specifically requires it or our team has instructed you to do so.

3. How we use your information

We use app information for purposes connected with your training and the operation of the assessment process, including to:

  • link your recording to the correct student and assessment;
  • receive, store, review, mark and moderate assessment evidence;
  • communicate with you about an upload, assessment, complaint or support request;
  • maintain training, assessment and certification records;
  • meet our Registered Training Organisation, regulatory, audit and legal obligations; and
  • protect the app, our systems and students from misuse, unauthorised access or security incidents.

We do not publish assessment recordings or use them for advertising or marketing without separate permission, unless disclosure or use is otherwise authorised or required by law.

4. Camera, microphone and device permissions

The app may request access to your camera and microphone when an assessment requires a video or audio recording. The operating system controls these permissions. You can refuse or later withdraw permission in your device settings, but you may then be unable to complete that activity through the app.

If you cannot or do not want to use the app, contact Eclipse Education before your assessment deadline. An alternative assessment or submission pathway may be available depending on the unit and your circumstances.

Start a recording only when you are ready to complete the assessment. Do not use the app to record unrelated conversations, other people or private material.

5. When we share information

We do not sell your personal information or assessment recordings. We may disclose information where it is reasonably necessary for the purposes described in this policy, including to:

  • Eclipse Education staff, trainers, assessors and authorised contractors who need it to deliver, assess or administer training;
  • technology, hosting, storage, communications and support providers who help us operate the app and training platform;
  • ASQA, NCVER, government departments, auditors and other authorised bodies where required or permitted by law or the VET regulatory framework;
  • a school, employer or other authorised party where this is relevant to your training and permitted or required; and
  • professional advisers, law enforcement or other parties where necessary to respond to legal obligations, safety issues, complaints or security incidents.

We require service providers that handle personal information for us to protect it and use it only for authorised purposes. Their own privacy policies may also apply to information they handle directly.

Overseas processing

Depending on the service involved, some information may be handled by technology or support providers outside Australia. Providers and locations can change, so we do not publish a fixed country list in this app policy. You can contact us for current information about relevant overseas recipients. Where the APPs apply, we take the steps required before disclosing personal information overseas.

6. Security and retention

We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. Access to assessment evidence is restricted to people and providers who need it for authorised work. No method of transmission or storage can be guaranteed to be completely secure.

We keep assessment evidence for as long as reasonably necessary for marking, moderation, complaints, appeals, audits, training records and legal or regulatory obligations. Different records can have different retention periods. When information is no longer needed, we take reasonable steps to destroy or de-identify it, subject to recordkeeping requirements and any legal hold.

If we become aware of an eligible data breach, we will respond in accordance with the Notifiable Data Breaches scheme where that scheme applies.

7. Access, correction and privacy choices

You may ask us for access to personal information we hold about you, or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Send the request to admin@eclipse.edu.au with the subject line “Privacy request”.

We may need to verify your identity before responding. In some circumstances the law allows or requires us to refuse access or correction. If that happens, we will explain the reason where we are permitted to do so and help you understand any available review or complaint pathway.

You can choose not to provide information or permission requested by the app. The practical consequence may be that we cannot receive or assess the evidence through that pathway; contact us so we can discuss the available options.

8. Privacy complaints

If you believe we have mishandled your personal information, please contact us first so we can investigate and try to resolve the issue. Include your name, student or assessment reference if relevant, what happened, when it happened and what outcome you are seeking.

Send a privacy complaint to admin@eclipse.edu.au or call (03) 5201 0569. We will review the complaint and respond in accordance with our complaints process.

If you are not satisfied with our response, or do not receive a response within a reasonable time, you can contact the Office of the Australian Information Commissioner (OAIC). The OAIC generally expects you to complain to the organisation first.

9. Contact and changes to this policy

This policy was last updated on 9 August 2026. We may update it when the app, assessment process, technology providers or privacy requirements change. The current version will be published at this URL.

If we collect personal information from you in another form or service, we may give you additional information at the time of collection. Apple and Google separately handle information associated with their app stores, accounts and device services under their own terms and privacy policies.
